Terms and Conditions of Estimate:
This estimate is provided by Superior Gutters (“Contractor”) and is subject to the following Terms and Conditions. By accepting this estimate, the customer (“Client”) agrees to these terms:
1. Estimate Validity: This estimate is valid for 30 days from the date issued. After this period, pricing and availability may be subject to change.
2. Scope of Work: The estimate includes only the materials, labor, and services explicitly listed. Any additional work requested by the Client not listed in the estimate may incur additional charges and require written approval.
3. Payment Terms: A deposit of 50% is due upon acceptance of the estimate to secure materials and schedule the project. The remaining balance is due immediately (the day of) completion of the work. Late payments may incur a 1% late fee per month until paid in full. Gutters installed remain the property of Superior Gutters until paid in full and may be removed by the contractor if not paid within 3 months.
4. Workmanship Warranty. Superior gutters provide a 3-year limited warranty on workmanship. Covers: Leaks at seams or miters, Improper installation, Sagging or poor slope causing water pooling, Fastener or bracket failure due to poor workmanship. Warranty excludes damage caused by natural disasters, acts of God, or customer misuse or neglect.
5. Material Warranty: Typical Duration: 20 years & Covers: Cracking, peeling, or flaking of paint, Corrosion or rust on aluminum, Color fading (to a certain extent)
6. Limitation of Liability: The Contractor will not be held liable for pre-existing structural damage or issues discovered during the installation. Any structural repairs required to proceed with gutter installation are the Client’s responsibility.
7. Fascia Board Requirement. If the fascia board is improperly installed, damaged, or the wrong size, it will be replaced on-site at the homeowner’s expense, billed at $10 per linear foot. Proper fascia is required for a secure and lasting gutter installation.
8. Acceptance of Estimate. By approving this estimate, either verbally or in writing, the Client agrees to all Terms and Conditions herein.
9. Permit & Code Compliance (Optional if applicable in your area): “The Client is responsible for ensuring that all necessary permits or approvals from local authorities are obtained before commencement of work. Superior Gutters will perform work by standard industry practices but is not responsible for local code compliance unless specified in writing.”
10. Access and Utility Responsibilities: Clarifies what the client needs to provide: “Client shall provide clear access to the work area and ensure that all utilities (e.g., power, water) are available during installation. Delays due to inaccessibility or lack of utilities may incur additional charges.”
11. Change Orders: “Any changes to the original scope of work must be documented and approved in writing. Change orders may affect the project timeline and total cost.”
12. Weather Delays: “Contractor is not responsible for delays caused by weather conditions or other events beyond our control. Any such delays may result in rescheduling without penalty.”
13. Cleanup and Debris Removal: “Contractor will perform basic site cleanup upon completion. Excess materials and debris will be removed unless otherwise specified. The client is responsible for disposal of old gutters unless included in the estimate.”
14. Right to Photograph Work: “Contractor reserves the right to photograph completed work for portfolio or marketing purposes. No identifying features (e.g., addresses or license plates) will be shown without client consent.”
15. Dispute Resolution / Jurisdiction: “The laws of the State of Wisconsin shall govern any disputes arising from this agreement. Both parties agree to attempt mediation prior to pursuing legal action.”
